This Privacy Policy (the “Policy”) covers any personal information Horizon Uptown (Denver) SPV, LLC, a Florida limited liability company (“we,” “us,” “our,” or “Horizon”) obtains when you, our customer (“you” or “User”) interact with or otherwise provide information through our websites (the “Websites”) or services (“Services”). Horizon is committed to providing excellent service to you, including respecting your privacy and protecting your data. We understand that when you visit or use the Websites or use our Services you may have questions about whether and how the Websites or Services collect and use your information. We collect and use your personal information as described in this Policy.

This Policy may change from time to time to best meet the needs of our users and to reflect changes in local, state and federal laws. Your continued use of this Website and our Services after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Information We Collect About You and How We Collect It

Web Browser Cookies

We collect information about how you use the Websites by setting and accessing cookies on your computer. A cookie is a small piece of information that is saved on your storage drive by your computer’s browser. Pixel Tags

We may use pixel tags (also called web beacons or clear gifs) on the Websites. They can help us analyze what our customers like to do on the Websites and the effectiveness of our features and advertising. They can also help us customize your browsing experience. We may use information collected through pixel tags or tracked links in combination with your personal information. We may also combine personal information you provide to Horizon with other personal information such as demographic information. If we work with other companies to help us track, collect and analyze this information, they will be prohibited from using this information for any other purpose.

The Websites, including our service providers, may also use other technologies such as JavaScript. We may use local storage (HTML5). We may also permit third parties to use cookies, web beacons, JavaScript, and eTags on the Websites.

We may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and improve our Websites.

User-Provided Information

You may be requested to provide Personal Information to access or use certain parts of the Websites or our Services, or features of the Websites, or our Services, including without limitation, when you express an interest in or request updates about a property or a project, visit a sales office and complete a registration form, subscribe to a newsletter or email list, fill out a form, or participate in any of our special events or promotions such as contests, sweepstakes or surveys, or contact us with a comment, testimonial, question or complaint. This information is collected directly from you when you provide it to us.

Information From Third Parties

We may obtain information about you from a third-party website or application where we post content or invite your feedback or participation. We may obtain information from social media and blogs and other public sources.

We use this personal information to make our services and marketing efforts more efficient and personalized for you and to contact you about projects about which you have expressed an interest or that we believe you may have an interest in.

Log File Information

Log file information is automatically reported by your browser each time you access a web page. When you register with or view the Websites, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol addresses or other device identifiers, browser information, Internet Service Provider, operating system, location, date/time stamp, clickstream data, referring/exit pages and URLs, domain names, landing pages, pages viewed, and other such information.

III. PURPOSE FOR COLLECTING PERSONAL INFORMATION

Your personal information is collected for specified purposes and not processed further in ways incompatible with those purposes.   • To report visitor information to a community homebuilder of a neighborhood you have expressed an interest in.

We use device information and usage data from collected through automatic technologies via our Websites to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Websites; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our Websites and Services; (d) monitor aggregate metrics such as the total number of visitors and traffic to particular pages or properties; (e) diagnose or fix technology problems reported by our users or engineers that are associated with the IP addresses controlled by a specific web company or ISP; and (f) help you efficiently access information.

We may collect and use certain information about you and/or your user content without identifying you as an individual to third parties.

IV. PERSONAL INFORMATION SOLD OR SHARED

We do not sell your personal information.

In certain circumstances, we may share your personal information with our trusted partners as described below.

Third-Party Service Providers

We contract with companies, contractors or individuals that provide data storage, administrative, and support services to us such as webhosting, web analytics (including analysis of online activity over time and across websites), mailing, emailing, and other communications, marketing, administering our programs and operations, fulfilling your requests and orders, administering promotions and surveys, data management, or processing any other information on our behalf to provide services available at the Websites. These service providers may process personal information, if such information is needed to perform the services. Service providers are not authorized to use personal information beyond the instructions provided by Horizon.

Special Events, Promotions and Partnerships with Third-Parties

From time to time, we may join with third parties to provide specific services or products, special events or promotions (such as surveys, contests or sweepstakes). If you choose to sign up for such services, order these products, or participate in a special event or promotion, we may share your personal information with third party partners with your consent. We will share only the information that is necessary for the third parties to provide these services or products or otherwise participate in or administer the applicable event.

V. DATA SECURITY

We apply commercially reasonable and appropriate administrative, technical, and physical safeguards to protect the confidentiality, integrity, and availability of your personal information. Such safeguards protect against unauthorized access, alteration, disclosure, unlawful processing and accidental loss, destruction, or damage of your personal information. Although these safeguards reduce the risk of adverse effects to the confidentiality, integrity, and availability of your personal information, they cannot ensure or guarantee against the possibility of a security incident.

We sometimes use third party social media content we obtain from social media platforms such as Twitter, Pinterest, Facebook and Instagram on the Websites. The privacy protections provided on these third party social media platforms and sites are not part of our Policy and may differ from the privacy protections described in this Policy. If you upload content related to Horizon or our products on third party social media platforms or sites that share information with the general public, user community, and/or other third party sites, it may be used or shared by us on the Websites or our social media platforms to promote our products and services. Consequently, you should review the privacy policies of these third party sites before using them and ensure that you understand how your content may be used.

At various times during your use of the Websites, you may be presented with the ability to request to receive newsletters, emails, push notifications or other communications from us, including those about projects or communities you are interested in and other communications that are promotional in nature. If you do not want to receive such communications, do not opt in. Alternatively, if you initially decide to receive communications from us, but at a later date wish to remove your information from our database, you can do so by using the unsubscribe link at the bottom of our communications. You may also at any time opt out of receiving communications from us. Opting out may prevent you from receiving email messages regarding updates, improvements, promotions or offers.

Please note that even if you unsubscribe or opt out from our communications, it may take a while to remove your information from our files. Please allow up to ten (10) business days for us to process your request. We may continue to send you transactional or operational communications.

VI. DATA RETENTION

Your personal information is retained for as long as reasonably necessary and proportionate to achieve:

  1. The purposes for which your personal information was collected and processed.
  2. Another disclosed purpose that is compatible with the context in which your personal information was collected.

VII. CALIFORNIA SHINE THE LIGHT LAW AND DO NOT TRACK

If you are a California resident and have an established business relationship with us, you may request that we not disclose your personal information to third parties for the third parties’ own direct marketing purpose (as defined in California Civil Code section 1798.83).

Note that we do not currently respond to web browser “do not track” signals. Although a protocol for the “do not track” signal was adopted, the standard for how to respond to the signal was not adopted.

VIII. CHILDREN’S PRIVACY AND AGE-RELATED INFORMATION COLLECTION POLICIES

The Websites contains general information and is not intended for nor directed toward children under 18 years of age. We do not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on the Websites or on or through any of its features, use any of the interactive or public comment features of the Websites or provide any personal information about yourself to us. If we learn we have collected or received information from a child under 18 we will delete that information. If you believe that we might have any information from or about a child under 18, please contact us.

IX. LINKS TO NON-HORIZON WEBSITES

The Websites may contain links to third-party websites, services, or resources that are not covered under this Policy or our Terms of Use. Upon visiting or using those third-party websites, services, or resources, we recommend that you review their privacy policy, terms and conditions, and terms of use before providing your personal information.

X. TRANSFER OF CORPORATE ASSETS

If Horizon is acquired by or merged with a third-party entity, Horizon reserves the right to transfer or assign the personal information you provided to us as part of such merger, acquisition, sale, or other change of control to the new entity. In the event of bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditor’s rights generally, we may not be able to control how your personal information is processed.

XI. CHANGES TO THIS PRIVACY POLICY

We reserve the right to update this Policy to accurately disclose to changes as necessitated by applicable laws and other events. If those changes are material in nature, we will notify you by a notice placed on the Websites, a notification within our Services, and/or by electronic mail.
